Terms of service
These terms govern your use of Sincerely at trysincerely.com (the “Service”). By creating an account or using the Service you agree to them. If you use the Service for an organization, you represent that you can bind that organization.
The service
Sincerely turns B2B direct mail into software: audiences from your CRM or CSVs, personalized printed pieces produced through third-party fulfillment partners, and measurement of outcomes against holdout groups. We may change or improve features over time; we will not materially reduce the core service you have paid for during a paid term.
Your data and responsibilities
You retain all rights to the data you bring — CRM records, CSVs, brand assets, and message content. You grant us the rights needed to operate the Service on that data (including sharing recipient names and postal addresses with print and mail partners). You are responsible for having a lawful basis to mail the recipients you target, for the accuracy of recipient data, and for the content of your mail. Prohibited: unlawful, deceptive, harassing, or hateful mailings; mailing individuals you know have asked not to be contacted; and any use that violates postal regulations.
Mail fulfillment
Physical production and delivery are performed by third-party partners and the postal service. Delivery dates are estimates, not guarantees. Cancellation of a submitted piece is best-effort within the vendor’s cancellation window; once a piece enters production it may not be cancelable. Suppression requests are honored immediately for all future production.
Fees and billing
Fees are as posted on our pricing page or as otherwise agreed in writing: subscription plans plus per-piece production costs, with prepaid credit balances where applicable. Fees are charged through Stripe. Except where required by law, payments are non-refundable; unused prepaid credits roll over per the posted pricing terms. We may change prices with notice effective at your next renewal.
Measurement
Readouts, lift estimates, and confidence intervals are statistical estimates produced from your campaign design. We work to make them honest — including telling you when a result is not statistically ready — but we do not guarantee business outcomes, response rates, or revenue.
Intellectual property
We own the Service and everything in it except your data. You may not copy, resell, or reverse-engineer the Service. Feedback you give us may be used without obligation.
Disclaimers and liability
The Service is provided “as is” without warranties of any kind, express or implied. To the maximum extent permitted by law, neither party is liable for indirect, incidental, special, or consequential damages, and our total liability under these terms is capped at the fees you paid us in the twelve months before the claim arose. You will indemnify us against claims arising from your recipient data or mail content.
Termination
You may stop using the Service at any time; paid terms run to the end of the billing period. We may suspend or terminate for breach of these terms, with notice where practicable. On termination we will make your data available for export for a reasonable period before deletion.
General
These terms are governed by the laws of the State of Delaware, excluding its conflict-of-laws rules. If a provision is unenforceable, the rest remain in effect. These terms plus any order form are the entire agreement. We may update these terms; material changes will be notified and take effect at your next renewal or thirty days after notice, whichever is later.
